FREQUENT DEED RESTRICTION VIOLATIONS

Below is a list of deed restrictions that we see frequently and are the most common violations.

  1. Lawns should be mowed, edged, weeded, and free of any debris regularly.
  2. Parking on the lawn/yard or sidewalk is not allowed. Street parking – all vehicle’s right-side wheels must be parallel and within 18 inches of the curb.
  3. Inoperable or abandoned vehicles are not allowed in the community or on roadways. They will be towed after a warning. Inoperable or abandoned vehicles are not allowed on driveways and they will be towed by special operations deputy after a warning.
  4. Trailers, boats, campers, mobile homes, motors, food trucks, eighteen wheelers, or any type of commercial vehicles are not allowed in the community.
  5. Garbage cans should not be stored in public view. Garbage cans, bagged garbage, barbeque pits, toys, etc. should be stored in the backyard or garage out of public view. On regular trash pick-up days, all garbage should be placed in sanitary containers and the lid must close. Garbage cans should not be placed out before 8:00 PM the day before trash pick-up.
  6. Heavy trash day is the 1st Friday of each month. Heavy trash out on any other day is a $300.00 Fine. Harris County Precinct 1 Heavy Trash Disposal & Recycle Center (281-452-1633) 15530 Miller Rd 1 (3rd Saturday) from 8:00 a.m. to 1:00 p.m. Call them for more information.
  7. Individual garage sales are not allowed.
  8. A/C windows units are not allowed.
  9. Basketball goals are not to be in the street at any time. Driveway only. Basketball goals should be facing across (perpendicular) the driveway.
  10. Pets must be leashed when not enclosed. All residents must abide by the Pooper Scooper law. Household pets can’t exceed three (3) medium-sized dogs and/or cats.
  11. Fences need to be in good, presentable condition and built according to covenant guidelines.
  12. Flyers, advertisements, lost pet signs, etc. are not allowed to be posted in community, on mailboxes, or light poles.
  13. Burning of any type of debris is not allowed.
  14. Architectural Control Committee approval is required for ALL paint color changes and exterior modifications. (Forms are available at the SGS office).
  15. Businesses are not allowed to operate within this community.
  16. Using property for illegal or immoral purposes.
  17. Noise ordinance in this community including loud music, parties, barking, loitering, etc.
  18. Sterling Green South is a single-family dwelling community. MULTIPLE FAMILIES DWELLING IN ONE HOUSEHOLD IS NOT ALLOWED!!
  19. All fireworks are banned within Sterling Green South. Violation of this covenant ordinance is a $500.00 Fine. Firework trash is a $500.00 Fine and public nuisance from the loud noise is a $500.00 Fine.

According to the Texas Property Code 209.006 (h)(i), these are examples of curable violations:

  1. A parking violation;
  2. A maintenance violation;
  3. The failure to construct improvements or modifications in accordance with approved plans and specifications; and
  4. An ongoing noise violation such as a barking dog

These are examples of uncurable violations:

  1.  Shooting fireworks;
  2. An act constituting a threat to health or safety;
  3. A noise violation that is not ongoing;
  4. Property damage, including the removal or alteration of landscape;
  5. Holding a garage sale or other event prohibited by a dedicatory instrument.http://statutes.capitol.texas
